Dubai doesn't tax you on owning property. No annual property tax, no capital gains tax on the sale, no personal income tax on the rent you collect. That's real, and it's a large part of the appeal for Dutch buyers. What it doesn't mean is that the Netherlands stops caring. If you're a Dutch tax resident, that apartment in Dubai Marina still shows up on your Dutch tax return, and understanding exactly how takes untangling three separate systems: Dutch box 3, the Netherlands-UAE tax treaty, and UAE corporate tax.

Box 3: your Dubai apartment is a Dutch asset now
------------------------------------------------

If you're a Dutch tax resident, box 3 (the tax on savings and investments) covers your worldwide wealth, not just what's sitting in a Dutch bank account. A property in Dubai counts as a second home (2e woning) for box 3 purposes, valued at its fair market value as of 1 January of the year before the tax return, in unoccupied condition.

For 2026, box 3 works like this, according to the Belastingdienst:

- **Tax-free allowance (heffingsvrij vermogen):** EUR 59,357 per person, applied across all your box 3 assets combined, not per asset.
- **Tax rate:** 36% on the taxable amount above that allowance.
- **Deemed return (forfaitair rendement):** the Belastingdienst assumes a fixed return depending on the type of asset. Bank savings are deemed to return 1.28%, debts are deemed to cost 2.70%, and "investments and other assets," which is the bucket a second home abroad falls into, is deemed to return 6.00%.

So if your Dubai apartment is worth EUR 400,000 and it's the only box 3 asset you hold, the calculation (simplified, ignoring the allowance interaction with other assets) works out to roughly: EUR 400,000 × 6.00% deemed return = EUR 24,000 deemed income, taxed at 36% after the allowance is subtracted from your total box 3 base. The property itself isn't taxed; a deemed return on its value is.

If your actual return on the property is demonstrably lower than the deemed 6.00%, current rules already let you make that case using the counter-proof mechanism (tegenbewijsregeling) that followed the 2021 Supreme Court ruling on box 3. Whether that's worth pursuing depends on your numbers and is exactly the kind of calculation a tax adviser earns their fee on.

A mortgage you took out to buy the property also enters the box 3 calculation, on the debt side, at the 2.70% deemed cost rate, which reduces your net taxable base. The reform that isn't law yet
-----------------------------

You may have read that box 3 is moving to a system based on actual returns instead of the deemed percentages above. That's true as a direction of travel, and false as a description of current law. The "Wet werkelijk rendement box 3" bill has passed the Tweede Kamer, but the Eerste Kamer still has to review and vote on it, and the government has already signalled it expects to bring amendments before Prinsjesdag 2026. The intended start date has already slipped once, from 2027 to 2028.

Until that changes, the deemed-return system above is what applies. Don't plan around a 2028 start date as if it's confirmed; check belastingdienst.nl or rijksoverheid.nl for the current status before making decisions based on it.

The NL-UAE tax treaty: who gets first claim
-------------------------------------------

The Netherlands and the UAE have a bilateral tax treaty in force, and it directly addresses real estate. Article 6 states that income from immovable property may be taxed in the country where the property is located, meaning the UAE gets the primary taxing right over rental income from your Dubai property. Article 13 extends the same principle to gains on disposal: profit from selling the property may also be taxed where the property sits.

In practice, since the UAE doesn't levy personal income tax or capital gains tax on individuals, that "right to tax" produces zero UAE tax on rental income or sale profit for most individual owners. The treaty doesn't create a UAE tax that doesn't otherwise exist; it just confirms the UAE's right to tax it if it wanted to.

The trickier question is what happens on the Dutch side, because box 3 isn't structured as a tax on rental income or sale profit; it's a wealth tax on deemed returns from your asset base. Dutch relief from double taxation for foreign real estate normally works through a proportional exemption: the Netherlands calculates the box 3 tax as if the foreign property were fully included, then grants a reduction based on the share that property represents of your total box 3 wealth, under the mechanism set out in the Besluit voorkoming dubbele belasting 2001. The property still gets reported, but the tax on it is meant to be relieved rather than doubled. Given how box 3 has been in litigation and revision over the past few years, this is a calculation worth having a Dutch adviser run for your specific numbers rather than estimating yourself.

UAE corporate tax: usually doesn't touch you
--------------------------------------------

The UAE introduced a 9% federal corporate tax in 2023, and it's a fair question whether it applies to individual property owners. According to the Federal Tax Authority's own guidance for natural persons, the answer for most Dutch buyers is no. Real estate investment income earned by an individual, meaning rental income and gains on sale, is generally out of scope of corporate tax entirely, as long as you're not operating a licensed real estate business (property trading, development, professional management services run as a business).

That "out of scope" status doesn't get consumed by a turnover threshold either. The FTA guide is specific that personal investment income and real estate investment income earned by a natural person don't count toward the AED 1 million turnover figure that triggers corporate tax registration for other business activities. If you buy an apartment personally and rent it out, you're very likely outside UAE corporate tax altogether, full stop, not just under a small-business exemption.

Where it changes is if you hold the property through a company, whether a UAE-incorporated entity or an offshore structure that becomes subject to UAE tax. In that case, the 9% rate applies to taxable profit above AED 375,000, the threshold set by Cabinet Decision No. 116 of 2022, unless the entity qualifies for a specific exemption. That threshold is a tax-rate band, separate from Small Business Relief — a different mechanism, under Ministerial Decision No. 73 of 2023, letting resident businesses with revenue under AED 3 million elect to be treated as having no taxable income at all. That's a structuring decision, not a default, and it's usually not worth setting up a company purely to hold one personal-use or single rental property; the added compliance tends to outweigh the benefit at that scale.

Emigration and the residency question
-------------------------------------

Box 3 is a Dutch tax on Dutch tax residents' worldwide wealth. If you're not a Dutch tax resident, the calculation changes completely: the Belastingdienst confirms that non-residents are only taxed on specific categories of Dutch-situated assets, and foreign real estate isn't one of them. In plain terms, if you genuinely emigrate from the Netherlands and become a non-resident for Dutch tax purposes, your Dubai property drops out of box 3 scope entirely.

Whether you actually qualify as a non-resident isn't a matter of counting days against a fixed threshold. Dutch domestic tax residency is decided on a facts-and-circumstances basis: where your permanent home is, where your family lives, where your economic ties sit, and similar factors, looked at together rather than against one number. If you end up considered a tax resident of both the Netherlands and the UAE under each country's own rules, the treaty's tie-breaker provisions step in, looking at your permanent home, centre of vital interests, and habitual abode in that order. This is exactly the kind of borderline situation where guessing costs money; if you're genuinely relocating rather than just buying an investment property, get that assessed properly before you assume either outcome. Rental income and yield, in context
-----------------------------------

On the Dutch side, remember that box 3 doesn't care whether the property is actually earning rent or sitting empty; the deemed return applies either way, based on the property's value, not its cash flow. A vacant unit and a fully let one at the same valuation are taxed identically in box 3, which is worth knowing before assuming rental income determines your Dutch tax bill.

When to bring in a Dutch tax adviser
------------------------------------

Get professional advice before filing, not after, if any of the following applies to you: you're close to being tax resident in both countries, you're weighing whether to hold the property personally or through a structure, you want to test whether your actual return is meaningfully below the 6.00% deemed rate, or your Dubai holding is large enough relative to your other assets that the double-tax relief calculation actually moves the number. For a single mid-market apartment held personally and fully within Dutch residency, the mechanics above are usually enough to estimate your own exposure, but a belastingadviseur is still the one who should sign off on the actual return.

Do I pay any tax in the UAE on rental income from my Dubai property?+No personal income tax applies to individuals in the UAE. If you hold the property personally rather than through a business structure, UAE corporate tax doesn't apply either, per the Federal Tax Authority's guidance for natural persons.

Do I pay Dutch tax on the rent itself, or on something else?+Box 3 taxes a deemed return on the property's value (6.00% for 2026), not your actual rental income. Whether the unit is rented or empty doesn't change the calculation.

Is the 2028 shift to taxing actual returns something I should plan around now?+Not as settled law. The bill has passed the Tweede Kamer but still needs Eerste Kamer approval, and the government has signalled likely changes before that vote.
